Terms of Service

Governing law: MISUS operates from Poland. These Terms are governed by Polish law; the Polish version at misus.pl/regulamin is the reference text and this English translation is provided for convenience.

1. Provider

The service provider is Maciej Jancz, operating under the brand MISUS, address: Niewierowo 32, 76-200 Słupsk, Poland, email: kontakt@misus.pl. The business currently operates as działalność nierejestrowana (an unregistered small-scale business under Polish law).

2. Scope of services

MISUS designs, deploys and maintains business websites. Optionally, it also runs Google Business Profile, social media profiles and small online administrative tasks (virtual assistant). MISUS does not publish a price list or fixed packages. Scope, delivery and fees are agreed individually with each client and recorded in a contract or email exchange.

Standard scope may include: design, hosting, standard domain, SSL certificate, technical maintenance, an agreed number of ongoing changes and support during: Monday–Friday, 9:00–17:00 (business days). Additional areas (Google profile, social media, virtual-assistant tasks) are always agreed individually.

3. Formation of the contract

A contract is concluded in writing or documentary form (e.g. email exchange with acceptance of the offer). Submitting the contact form on the website is not the conclusion of a contract. It is a request for information.

4. Term and termination

Contract duration, any minimum engagement period and notice period are agreed individually and recorded in the contract or an email confirmation. The contract does not auto-renew. Continuation requires an explicit agreement of the parties.

5. Payments

Payment method and frequency are set in the contract. The first payment is due before service starts unless otherwise agreed. Amounts stated in the contract are the final amount payable.

Because of the business form (unregistered small-scale business), MISUS is not a VAT-registered taxpayer and does not add VAT. This will be updated after formal business registration.

6. Changes and additional work

The scope of ongoing changes and how they are billed (an allowance, separate quote) is set in the contract. A new subpage, new functionality, extended integration, shop, payments, a login system or a major redesign are not standard changes and are quoted separately.

7. Ownership and licence

Content and creative assets provided by the client remain the client's property. A domain registered in the client's name remains theirs after the contract ends. During the contract, MISUS grants a non-exclusive licence to use the site design as part of the service. Code, configuration and hosting infrastructure remain the property of MISUS; once the contract ends, the site is no longer hosted or maintained under the subscription.

8. Complaints

Complaints should be sent to kontakt@misus.pl within 14 days of discovering the issue. MISUS will respond within 14 days of receipt.

9. Liability

MISUS's liability for non-performance or improper performance of the contract is limited to the fees paid by the client in the six months preceding the event giving rise to the claim, except where liability cannot be limited under mandatory law.

10. Governing law

Polish law governs. Jurisdiction lies with the court competent for the provider's seat, subject to mandatory rules.

11. Changes

Current version: 1.0, in force from 21 July 2026. Changes are announced with at least 14 days' notice to the email in the contract.
